Booking Terms and Conditions

About:
M.B.M Chalets (MBM) is property management provider, property service provider, property rental provider and property rental broker . We manage properties on behalf of owners (Owners) which may include marketing and short-term lettings to guests (Guest/s). We provide services to property owners and guests who book to stay in those properties.

Scope:
The terms and conditions in this booking agreement apply to Guest/s who book accommodation through MBM and pay a rental fee and/or other service fees to MBM.

Booking Agreement:
A booking agreement is established when Guest/s accept an offer of accommodation and/or services for a fee in writing and a booking deposit is made. Acceptance of a booking can be made by e-mail, by electronic message, by telephone or via the Internet deposit is made. MBM will confirm the booking before it becomes valid. Once the booking has been confirmed any changes by the Guest/s need to be agreed by MBM before they become valid. Cancellation by the Guest/s are subject to the Cancelation Policy (16).

Booking Deposits:
Booking deposits must be made at the time of booking or by special arrangement as agreed in writing by MBM. No booking is valid until the deposit has been paid in full.

Balance of Payments:
The balance of payment must be made by the specified time/s for the booking to remain valid.

Damage Deposit (End of Stay Deposit):
Bookings will incur a pre-authorised or pre-paid damage deposit. Damage deposits in full, or a portion thereof, will only retained where there are damages or loss to the property. Damage or loss includes external property damage or loss including gardens and driveways. Damage or loss includes internal property damage to contents and/or fixtures and fittings; breakages to property contents or where additional cleaning or services are required to return the property to its pre-check-in standard. Where damaged items need to be replaced or repaired, MBM will pass on the cost of the replacement or repair to the Guest/s at cost. Where MBM cleaning or other services are required, including time taken in replacing or repairing damaged items, these services will be charged at the prevailing hourly rate. Damage deposits (less any deductions) are returned to the guest within three to five working days. Guest/s agree to report any damage and/or breakages to MBM prior to their departure. Guest/s agree to leave the property in a tidy and reasonable state of cleanliness prior to their departure. Guest/s agree not to leave dirty crockery, glassware, cutlery or kitchen equipment prior to their departure. Guest/s agree to remove all their personal possessions prior to departure. Guest/s agree to dispose of all rubbish and recycling to the designated locations prior to their departure. Should Guest/s prefer MBM to dispose of all rubbish and recycling to the designated locations, or they do not have time to dispose of all rubbish and recycling to the designated locations, MBM will make a fixed charge of CHF 200 deductible from the deposit.

Prices:
MBM reserves the right to alter prices it publishes from time to time. Where MBM is obliged to accept increases in costs due to taxes, exchange rates or other surcharges outside of its control, MBM can pass those increases to the Guest/s or allow the Guest/s to cancel their booking without penalty.

Personal Property Insurance:
No insurance cover will be provided to Guest/s for personal property or effects. MBM does not accept liability for Guest/s personal property or effects.

Personal Insurance:
It is a condition of every booking that Guest/s are adequately insured for any winter or summer activities they will undertake while on holiday. These might include skiing, and off-piste skiing during the winter. Guest/s must have medical expenses and repatriation cover for the period of their holiday. Guest/s are advised to have holiday cancellation insurance.

Representation of Properties:
Images and descriptions of properties are made accurately and in good faith at the time of listing. Some interior furnishings and room layouts may change from time to time.

Check-in & Check-out Times:
Check-in is not before 16:00 on the day of arrival. Check-out is before 10:00 on the day of departure. Where possible MBM will show flexibility on request for early and late check-in and check-out.

Complaints:
Should you have a compliant before, during or after your stay, please write to MBM at office@montbeaumenage.com All complaints will be acknowledged within 24-hours and dealt with promptly.

Restrictions & Rules:
Guest/s agree to respect local regulations and laws, and to abide in full to restrictions and house rules of the property. Restrictions and house rules are shown on the Booking Agreement.

MBM Liability:
MBM do not accept liability for loss resulting from force majeure, war, terrorism, natural disasters, pandemics, epidemics, disruption to transport networks, extreme weather or if the property becomes unfit for purpose. MBM’s liability to Guest/s is limited to the amount of rent paid. MBM do not exclude or limit liability for death or personal injury which arises as a result our or negligence or that of our employees while acting in the course of their employment, or for any other liability which may not be excluded or limited as a matter of law.

Guest/s Liability:
All Guest/s who form a party will be jointly and severally liable for the total rent and for any damage or loss caused by them.

Cancellation Policy (cancellation by Guest/s):
If cancellation occurs between 121 and 180 days prior to arrival, 55% of the total booking is refundable.
If cancellation occurs between 91 and 120 days prior to arrival, 45% of the total booking is refundable.
If cancellation occurs between 61 and 90 days prior to arrival, 35% of the total booking is refundable.
If cancellation occurs between 31 and 60 days prior to arrival, 25% of the total booking is refundable.
If cancellation occurs between 0 and 30 days prior to arrival, 0% of the total booking is refundable.

Cancellation Policy (cancellation by MBM and/or Owner):
Should there be compelling circumstances that require MBM and/or the Owner to cancel the booking, MBM will offer the Guest/s alternative accommodation or a full refund. Compelling circumstances include force majeure, war, terrorism, natural disasters, pandemics, epidemics, disruption to transport networks, extreme weather or if the property becomes unfit for purpose.

Construction Work:
MBM cannot accept any liability for disruption or inconvenience caused by construction work nearby the rented property that is outside of its control.

Utility Providers:
MBM cannot accept any liability for disruption or inconvenience caused by electricity supply, water supply or internet supply that is outside of its control.

Governing Law and Jurisdiction:
The Booking Agreement and Terms and Conditions shall be governed by and construed in accordance with the laws of Switzerland. Any disputes arising from this Agreement shall be subject to the exclusive jurisdiction of the courts of the place of MBM’s registered office (Riddes - Valais).
